Moving States to Lower Taxes: What Contractors Need to Know Before Relocating

What California Actually Audits
California's Franchise Tax Board doesn't care about your new Texas driver's license. They care about where your life actually is. They will examine: lease and mortgage records (did you keep the California house?), children's school enrollment, voter registration, vehicle registration, bank and brokerage account addresses, country club memberships, religious organization affiliations, doctor and dentist appointments, and โ increasingly โ cell phone geolocation data.
If 26 out of 30 indicators still point to California, your Nevada LLC doesn't save you.
How to Do It Right
A clean residency change requires substance: sell or rent out the California home, enroll kids in new-state schools, register to vote in the new state, change vehicle registration, move primary banking relationships, establish new doctor/dentist, join local organizations, and โ critically โ actually spend the majority of your time in the new state.
The closer-connection test weighs all factors. No single factor is dispositive, but keeping a California home while claiming Texas residency is almost guaranteed to trigger an audit.
The Nexus Alternative
Even without moving, multi-state contractors can optimize where income is sourced. If you have crews in Arizona, Nevada, or Texas, revenue attribution rules vary by state. Proper nexus planning can shift meaningful income to lower-tax jurisdictions without changing your personal address.
